CONDITIONS OF SALE

The conditions herein described govern the sale of paintings by artupdeco.com. These conditions take precedence over any
other conditions published elsewhere, notably those pertaining to any of Art Up Déco’s showspaces.

ARTICLE 1 - PRICES
1.1 - The prices of our paintings are given in euros. They include all taxes payable in France, but exclude the costs of delivery (see Article 3 - Delivery).
1.2 - In the event of a purchase for delivery to a destination outside mainland France, you the customer are the importer of the goods in question. Paintings despatched outside the European Union or DOM-TOM territories are liable to attract customs duties or other local taxes, import duties or state taxes. Art Up Déco denies any liability for any of these duties, taxes or fees, which must be settled by you. You are also entirely responsible for any disclosure or payment requirements demanded by the authorities in your own country. We recommend that you inform yourself of any requirements of this sort in advance of purchase by consulting the relevant authorities in your country.
1.3 - All purchases, wherever they may be placed, must be settled in euros.
1.4 - Artupdeco.com reserves the right to alter its prices at any time without notice. Goods will be invoiced at the price payable at the time an order is placed, subject to availability.
1.5 - The goods ordered remain the property of artupdeco.com until full payment of the advertised price has been received.

ARTICLE 2 - PLACING AN ORDER

Artupdeco.com reserves the right to cancel or refuse to accept an order from a customer with whom a legal dispute exists in relation to payment for a previous order.
Once you have clicked the box to confirm your order you accept without reservation all the conditions of sale herein described.
Artupdeco.com will confirm receipt of your order by electronic mail as soon as availability of the goods requested has been established and payment details have been validated.
Data recorded electronically or otherwise by artupdeco.com may constitute proof of the transaction between artupdeco.com and its customers.
Data recorded by the online payment system may constitute proof of financial transactions between artupdeco.com and its customers.

ARTICLE 3 - DELIVERY
Delivery will be made during normal office hours to the delivery address given by you on the order form, within 15 days of the date on which we confirm your order.
The transfer of risk attached to the work(s) of art purchased by you comes into effect as soon as the goods have been put into the hands of the delivery agent by artupdeco.com.

In order to qualify for insurance cover, it is your responsibility, in the event of breach of liability or damage to your goods in transit, to notify the delivery agent by giving full details in writing of any complaint together with the inscription SR (“Sous Réserve” – with provisions) on the delivery document.

The costs of delivery are calculated as follows:
1st painting (largest size): Full standard cost of delivery, according to size and destination. 2nd painting (second largest): 35% of standard delivery cost, according to size and destination. 3rd painting (third largest): 30% of standard delivery cost, according to size and destination.
The online calculation of delivery charges automatically takes account of the sizes of paintings ordered.
For all countries where direct delivery is available (and where additional local delivery costs do not apply), you pay delivery charges for up to three paintings only. Any additional paintings in the same delivery attract no extra charge.

ARTICLE 4 - PAYMENT
Settlement of your purchase may be made in euros only, by one of the following methods:
- credit card: Carte Bleue, Visa, Mastercard, American Express.
Payment will be debited from your card only on the day that your order is despatched.
Secure online payment is provided by the Banque Populaire’s Cyberplus payment system.
- by bank cheque to the order of Art Up Déco, drawn on a bank located in mainland France or Monaco, and sent to Art Up Déco – Customer Relations, 5 cour du Marché Saint-Antoine, 75012 Paris, France.

If the value of your order exceeds the value of your voucher, please cover the difference with a cheque drawn on a French bank, to the order of Art Up Déco.

ARTICLE 5 : SECURITY OF PAYMENT
Our website offers a secure payment system called Cyberplus, provided by the Banque Populaire.

ARTICLE 6 - SATISFACTION OR REIMBURSEMENT GUARANTEE
6.1 - You may return your goods within 7 days without prejudice. The full costs of purchase and despatch will be reimbursed to you: however, the costs of returning the goods are your responsibility. Goods should be returned in their original packing, in good condition and accompanied by a copy of the invoice, to Art Up Déco – Customer Relations, 5, cour du Marché Saint-Antoine, 75012 Paris, France.
6.2 – Reimbursement will be made within 15 days of receipt of goods. It will be made, at Art Up Déco’s choice, either by bank transfer to your account, or by bank cheque made out to the customer name given on the original order form and sent to the invoice address given.
6.3–No goods will be accepted as partial reimbursement, for whatever reason.

ARTICLE 8 – AUTHOR’S RIGHTS
As the author of the work of art, by French law the artist retains the right to any royalties pertaining to his/her work. The rights of representation and reproduction of the works featured on the artupdeco.com website belong to their authors and to Art Up Déco. Their joint authorisation is required for any exploitation of these rights. Your rights over the work purchased are therefore limited to its private enjoyment, and exclude any right of representation or reproduction.

ARTICLE 9 - DATA CONFIDENTIALITY
The data that you submit to us on the order form, confirmation order or by any other means may be stored electronically for the purposes of processing your order, safeguarding payment, despatching the goods ordered and marketing activities. These data may therefore be communicated by us, provided it is for one of the purposes stated above, to public organisations or private companies, in France or any other country. By confirming your order, you thereby authorise us to distribute your data under these conditions.
In accordance with French law (no. 78-17 of January 6 1978 – information technology and liberties), you have free access to these data, and are entitled to request their modification or correction, or demand their removal from our database. ARTICLE 10 – FORCE MAJEURE
In accordance with article 1148 of the French Civil Code, artupdeco.com cannot be held responsible or be considered to be at fault in the processing of your order, if any delay or inactivity is the result of force majeure.

ARTICLE 11 - GUARANTEES
Art Up Déco undertakes to respect any legal guarantee to which you are entitled. The works of art on our website are offered in accordance with the requirements of French law; however, we cannot be held responsible for violations of the law in any country outside France to which they may be delivered. We therefore recommend that you enquire about the legal position in your own country before you place your order.

ARTICLE 12 - LITIGATION: APPLICABLE LAW
This contract is governed by French law. Any dispute concerning the drafting, interpretation or execution of this contract will be submitted to the exclusive competence of the Paris Tribunal.
